In this GDPR Policy, we have included information on the processing of personal data within the framework of:

3.1. HANDLING CONTACT WITH OUR (POTENTIAL) CONTRACTORS AND PERSONNEL OF OUR (POTENTIAL) CONTRACTORS

3.1.1. Purposes of processing your personal data

If you are our (potential) contractor or a contact person from our (potential) contractor, your personal data will be processed by us to contact you on current matters, and in particular to respond to your inquiries and possibly conduct further contact, accept and present offers, conduct negotiations, as well as conclude and perform contracts between us and you or your employer / entity you represent and maintain relations with them.

3.1.2. Legal basis for processing your personal data

If you are our potential contractor, the basis for processing your personal data is the performance of the contract or taking steps to conclude it (Article 6, paragraph 1, letter b of the GDPR).

If you are an employee or collaborator of our (potential) contractor, designated for contact, then the legal basis for processing your personal data is our legitimate interest (Article 6, paragraph 1, letter f of the GDPR), consisting in maintaining relations and maintaining contact with our contractors.

3.1.3. Source of obtaining your personal data

We may obtain your personal data if:

you have provided us with your personal data yourself;

- the data has been provided in a publicly available source, in particular on the website of your company or the company of your employer / entity that you represent;

- your employer / entity that you represent has provided it to us as our (potential) contractor, indicating you as the contact person on their side.

If you are an employee or collaborator of our (potential) contractor, designated for contact, we process your data only to maintain contact with you and we do not process more data than your name, surname, position, telephone number and e-mail address.

If you are our (potential) contractor and we take steps to conclude a contract, then we additionally process your data necessary to conclude a future contract, i.e. business address, correspondence address, NIP number, REGON number. Other data may be processed by us only if we obtain them from you.

Providing your personal data is voluntary, however, we only collect data that is necessary for us, so without providing them we will not have the technical possibility to contact you or conclude a contract with you or your employer / entity that you represent.

3.1.4. The period of storage of your personal data

We will process your Personal Data for the period of ongoing communication - answering questions and possibly conducting further communication, preparing offers, exchanging further correspondence, etc. After this period, as well as in the event of concluding an agreement with you or your employer / entity you represent, your data may be processed until the limitation period for any claims.

In the scope of data processed by us on the basis of a legitimate interest, the data may be deleted earlier if you file an effective objection to their processing.

3.1.5. Recipients of your data

We will share your personal data only with entities with whom we cooperate in conducting our business (service providers), in particular providers of accounting, legal, IT, hosting services, etc.

3.2. CONTACT/CORRESPONDENCE SERVICES IN OTHER MATTERS

3.2.1. Purposes of processing your personal data

If you contact us or we contact you in matters other than to start cooperation with us as our contractor or a person designated for contact by our contractor, your personal data will be processed by us only for the purpose of handling the matter related to the contact.

3.2.2. Legal basis for processing your personal data

The legal basis for processing your personal data is our legitimate interest (Article 6, paragraph 1, letter f of the GDPR) consisting in handling correspondence addressed to us and handling current matters, e.g. official matters, etc. related to our business activity.

We process your data only if:
- you have provided it to us yourself or made it publicly available yourself or through your employer / entity that you represent.

If you provide us with your data yourself, then providing it is voluntary, however, without providing it, we will not have the technical possibility to contact you and deal with the matter you are contacting us about.

3.2.3. Period of storing your personal data

We will process your Personal Data for the period of ongoing communication - answering questions and possibly conducting further correspondence. After this period, your data may be processed until the limitation period for any claims expires.

Your data may be deleted earlier if you file an effective objection to their processing.

3.3. RECRUITMENT

3.3.1. Purposes of processing your personal data

If you intend to apply for a job with us, remember that it is sufficient for us to provide the data specified in the provisions of labor law. If you also provide us with other data that is not required by us, we consider that you consent to their processing. You can withdraw your consent at any time, but this does not affect the lawfulness of data processing before the withdrawal of consent.

As part of the recruitment process, we process personal data to assess your qualifications and experience for the position for which you are applying, to contact you to arrange meetings, conduct job interviews, negotiate a future contract and make a possible decision on your employment.

If you agree to this by sending your application, your data may also be processed by us in future recruitments, until you withdraw your consent.

3.3.2. Legal basis for processing your personal data

Your personal data are processed:

3.3.2.1. in the scope of data listed in art. 221 of the Labor Code, on the basis of the legal obligation incumbent on us as the administrator (art. 6 sec. 1 letter c of the GDPR in connection with art. 221 of the Labor Code);

3.3.2.2. in the scope of data not required by law and for the purposes of taking your candidacy into account in future recruitments, on the basis of your consent (art. 6 sec. 1 letter a of the GDPR);

The personal data you provide us with may also be processed on the basis of our legitimate interest (art. 6 sec. 1 letter f of the GDPR), consisting in:

3.3.2.3. pursuing possible claims or defending against such claims;

3.3.2.4. processing your personal data provided by you during the recruitment interview, in order to verify your qualifications and skills, in the position you are applying for.

3.3.3. Period of storing your personal data

We will process your personal data until the recruitment for the position you are applying for is completed, and after this period until any claims have expired.

In the scope of data processed by us on the basis of a legitimate interest, the data may be deleted earlier if you file an effective objection to their processing.

If you have consented to the processing of your personal data in recruitments conducted by us in the future or to the processing of data to a greater extent than we require, your data may be processed until you withdraw your consent.

3.3.4. Recipients of your data

We will only share your personal data with entities with whom we cooperate in conducting our business (service providers), in particular providers of accounting, legal, IT, hosting services, etc.

4. OTHER TYPES OF DATA PROCESSED BY FARMER CO.

4.1. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF PERFORMING A CONTRACT

Your personal data will also be processed in a situation where you decide to enter into a contract with us. Before collecting data for the purpose of concluding a contract, we provide detailed information regarding the processing of your personal data, regardless of whether you enter into the contract as our contractor or employee.

4.2. PROCESSING OF PERSONAL DATA IN OTHER CASES

In connection with the activities we conduct, we also collect and process data in other cases, for purposes related to initiating and maintaining business contacts, e.g. during business meetings, or by exchanging business cards, etc.

The legal basis for data processing in such situations is our legitimate legal interest (Article 6, paragraph 1, letter f of the GDPR) consisting in creating and maintaining relationships with our clients, contractors and co-workers.

Personal data collected in such cases are processed only for the purpose for which they were provided to us and are not transferred to any other persons, except entities with which we cooperate in conducting our business (service providers), in particular hosting providers, etc.

Your personal data collected in such cases will be stored for the duration of our relationship justifying mutual contact for the purposes of cooperation or until you object to the processing of your data.

5. TRANSFERRING DATA OUTSIDE THE EEA

We do not transfer your personal data outside the EEA.

6. YOUR RIGHTS RELATED TO THE PROCESSING OF PERSONAL DATA

6.1. RIGHTS RELATED TO THE PROCESSING OF YOUR PERSONAL DATA

In connection with our processing of your personal data, you have the following rights:

6.1.1. The right to access your personal data

On this basis, you can obtain information about the processing of your personal data by us, including in particular the purposes and legal basis of processing, the type (categories) of data, the recipients to whom we share your data and the planned duration of processing your data.

6.1.2. The right to obtain a copy of your personal data

In the event of such a request, you will receive a copy of your data that we process.

6.1.3. The right to request rectification of your personal data

If your data that we process is incorrect or incomplete, you can ask us to correct or supplement it at any time.

6.1.4. The right to request deletion of your personal data

You can request deletion of your personal data that we process, if it is no longer necessary for the implementation of any of the purposes for which it was collected.

6.1.5. The right to request restriction of processing of your personal data

In the event of a request to limit processing, your personal data will no longer be processed to a extent other than its storage, until the reasons for limiting its processing cease to exist. Apart from storage, your personal data during the period of limitation of its processing, may be processed exceptionally on the basis of your consent or for the purpose of establishing, pursuing or defending claims or for the purpose of protecting the rights of another natural or legal person or due to important public interest considerations.

6.1.6. The right to transfer your data

If we process your data in connection with a concluded contract or your consent, you can ask us to issue your personal data, provided by you, in a format that allows them to be read by a computer. You can also request that this data be sent to another entity, but only if it is possible due to the technical possibilities existing both on our side and the entity to which you want to send your data.

6.1.7. The right to object to the processing of your data

With regard to data processed on the basis of our legitimate interest (this is the basis indicated in art. 6 sec. 1 letter f of the GDPR), you can object to their processing at any time. Remember that your objection regarding processing in other areas should include justification. Without justification, you can object to our processing of your personal data for marketing purposes.

6.1.8. The right to withdraw consent to the processing of your data

In the case of processing your data based on your consent (the basis indicated in art. 6 sec. 1 letter a of the GDPR), you may withdraw your consent at any time. Withdrawal of consent does not, of course, affect the compliance of our processing of your data before the withdrawal of your consent.

6.1.9. The right to file a complaint with PUODO

If you believe that our processing of your personal data violates the provisions of the GDPR or other provisions regarding the protection of personal data, you have the right to file a complaint with the President of the Office for Personal Data Protection.

6.2. METHOD OF MAKING REQUESTS IN CONNECTION WITH THE PROCESSING OF YOUR DATA

You can submit any requests related to your rights to the processing of your personal data by us:

You will receive a response to your request in the same way you submitted your request to us, unless you clearly indicate in what form you want to receive it.

If we are unable to identify you based on your request, we will ask you to provide additional information.

The request to exercise your rights is considered within one month of its receipt. This period may be extended, in which case you will be informed about it together with the reasons for the extension
